Terms
Chumaly guarantees that your Maltese puppy is healthy at the time of delivery. Unless otherwise agreed to in writing by both the Buyer and Breeder, all puppies are sold as pets with limited registration.
The Buyer agrees, at their own expense, to have the puppy examined by a licensed veterinarian within seventy-two (72) hours of pickup or delivery. This examination confirms the puppy's health at the time it leaves the Breeder's care. Failure to have the puppy examined within 72 hours will void this health guarantee. Because Maltese are a toy breed, the Breeder recommends choosing a veterinarian who is experienced with small-breed dogs.
If, within one (1) year of the puppy's date of birth, the puppy is diagnosed with a life-threatening congenital or hereditary defect that significantly affects its quality of life, the Buyer must provide the Breeder with a written diagnosis from a licensed veterinarian. If the puppy dies, a necropsy performed at the Buyer's expense is required before any claim will be considered.
If a covered defect is confirmed, the Breeder's sole obligation is to provide a replacement puppy of equal value from a current or future litter, when one becomes available. The Breeder is not responsible for veterinary expenses, transportation costs, or any other related expenses. Under no circumstances shall the Breeder's liability exceed the original purchase price of the puppy.
This health guarantee does not cover conditions resulting from injury, accident, neglect, abuse, improper nutrition, lack of veterinary care, environmental factors, or improper use of medications or chemicals for flea, tick, or heartworm prevention. NO LEPTO VACCINE TO THIS TINY BREED!
This guarantee also does not cover conditions that are common, non-life-threatening, or difficult to prevent, including but not limited to:
- Internal or external parasites
- Coccidia
- Giardia
- Hypoglycemia
- Umbilical hernias
- Retained baby teeth
- Undescended testicles (cryptorchidism)
- Size or adult weight
- Allergies
- Kennel cough
- Bacterial infections
- Parvovirus contracted after the puppy leaves the Breeder's care
- Skin conditions
- Autoimmune disorders
The Buyer is responsible for discussing all vaccinations, medications, and preventive care with their licensed veterinarian. The Breeder's recommendations do not replace professional veterinary advice.
The Buyer and Seller agree that any claim or legal action arising from this Agreement shall be brought exclusively in the state or federal courts located in Alabama.
No modification or amendment to this Agreement shall be valid unless made in writing and signed by both the Buyer and the Breeder.
If any provision of this Agreement is found to be invalid or unenforceable, all remaining provisions shall remain in full force and effect.
By signing below, the Buyer acknowledges that they have read, understand, and agree to all terms and conditions of this Health Guarantee and accept full responsibility for the care and well-being of the puppy after pickup or delivery.
This Health Guarantee shall be governed by the laws of the State of Alabama and may be executed electronically.
